Florida cops won’t charge man in shocking parking lot shooting over state’s ‘stand your ground’ law

A fellow store patron shot and killed the man Thursday afternoon after a physical altercation erupted when the victim's girlfriend parked in a disabled spot, deputies said witnesses told them.

A video of the shooting shows Drejka initiating an oral confrontation with the occupants of a auto outside a convenience store near Clearwater on Thursday. Another man says he had the same argument with the suspected shooter a month ago. Drejka frequently visited the store and was angry over her use of the parking spot without a legal permit, Gualtieri said.

"According to witnesses, McGlockton exited the store and walked over to Drejka who was still arguing with Jacobs in the parking lot".

Drejka could be seen firing at McGlockton as the young father stepped away. Pinellas County Sheriff Bob Gualtieri said the state would not bring charges against Drejka, as the shooting "is within the bookends of "stand your ground" and within the bookends of force being justified". I'm not saying I agree with it, but I don't make that call'. The two got into a heated argument over proper parking etiquette that proved deadly for McGlockton, whose 5-year-old son witnessed the tragic incident.

Emotions are still running high after a man was killed during a confrontation over a parking space at the Circle A Food Store in Clearwater on Thursday, July 19. As the video clearly depicts, Drejka then produces a handgun discharges it in McGlockton's direction, who drags himself back into the store for assistance. "That pause gives me pause", Gualtieri said.

Now protesters say they feel very strongly that this shouldn't have fallen under "Stand Your Ground" because of how it all happened. The father ran back into the store where he collapsed and was later pronounced dead at a local hospital.

You may recall the Stand Your Ground law was changed a year ago.

Police say there was no arrest because of the state's "stand your ground" or "shoot first" status. Then, in an expansive 30-minute news conference, he tried to explain how the law connected to what was going through Drejka's mind when he pulled the trigger.

Richard Kelly, a regular at the convenience store, said he was confronted by Drejka once for parking his tanker truck in the same handicap spot.

Gualtieri said the "stand your ground" law is clear and subjective and that this incident "is within the bookends" of the self-defense law, which was recently modified. That's when Jacobs' boyfriend went outside and toward Drejka. Jacobs said before breaking down into tears.
