Apple’s iPhone 7 and 8 are now banned from sale in Germany

A German court on Thursday ruled in favour of U.S. chipmaker Qualcomm in a patent dispute case against Apple, which could lead to a ban on sales of iPhones in Germany.

"Their tactics, in the courts and in their everyday business, are harming innovation and harming consumers", it said. Just like China, Apple has again said that it'll appeal against the injunction.

Apple is pulling older models of its iPhone from German stores after losing two patent cases brought by chipmaker Qualcomm, the company said Thursday.

Apple's loss comes days after it suffered defeat on 10 December following a Chinese court's decision to ban iPhone sales due to similar patent disputes.

To be precise, the devices affected by the ruling are iPhone 7, iPhone 7 Plus, iPhone 8, and iPhone 8 Plus; newer models like iPhone XS and iPhone XR remain unaffected.

After losing a battle in China, Apple has now lost in another court in its ongoing feud with Qualcomm.

In Germany, Qualcomm is seeking a ban on some iPhones with chips from Intel Corp. The initial reports from the court indicated that Apple might not have to stop the retail of iPhone 8 and iPhone 7 as it was planning to appeal the ruling in the court. This technology is supplied by chip maker Qorvo for Intel-based iPhones and the company was sued by Qualcomm in the United States for the very same patent but Qualcomm lost that case. Apple accused Qualcomm of illegally charging too much for licences. The company noted, however, that all iPhone models remain available from cellphone carriers and resellers in the country.

The two U.S. companies are locked in a worldwide dispute over licensing fees Qualcomm charges for use of technology the chipmaker says underpins all modern phone systems.

Apparently, the schematics of the chip that Apple was found to have infringed on by the German court, were not shown to the judge in Munich. A permanent injunction has been issued, stopping Apple from selling any infringing iPhones in Germany. Intel and Qorvo provided the chips in the alleged infringing devices, CNBC said.

Qualcomm was not immediately available for comment.
