Lawmakers Reach Shutdown Deal, But Will Trump Sign It?

Levinson said to expect a legal battle once Trump declares a national emergency.

The US Congress is expected to vote later on Thursday on the government funding bill.

As more details about the package emerged, conservative figures in Mr Trump's orbit voiced new displeasure at the bill.

Funding for those agencies is due to expire on Friday, which would trigger another partial federal shutdown on Saturday morning if Congress and Trump do not act quickly.

"The president is once again delivering on his promise to build the wall, protect the border, and secure our great country", she said.

She insisted that the constitution gave the "power of the purse" to Congress, appearing to question whether Mr Trump was overstepping his powers.

"1000 pages filed in the in middle of the night take a little time to go through", one White House official told CNN's Jim Acosta.

Imagine indeed if, two years from now, a President Booker, Harris, Warren or Bennet, seizing on the Parkland massacre's anniversary, invoked emergency powers to halt the killing of innocents - by banning the sale of semiautomatic weapons, imposing uniform background checks for gun purchases or levying a stiff federal surtax on the sale of gun parts and ammunition. That would have infused fresh chaos into a fight both parties are desperate to leave behind, a thought that drove some lawmakers to ask heavenly help.

"He's prepared to sign the bill, he will also be issuing a national emergency declaration at the same time", McConnell said.

Her criticism came just after the White House confirmed that the president would sign off on the legislation, while also announcing that he would declare a national emergency at the U.S. -Mexico border.

The top Democrat in Congress denounced the president's move.

According to the statute, if the president declares an emergency "that requires use of the armed forces", the defense secretary "may undertake military construction projects, and may authorize the Secretaries of the military departments to undertake military construction projects, not otherwise authorized by law that are necessary to support such use of the armed forces".

GOP critics included ME senator Susan Collins, who said emergency declarations are for "major natural disasters or catastrophic events" and said its use would be of "dubious constitutionality".

Last month, Trump highlighted words from Rep. Adam Schiff about Trump's ability to use a national emergency to suggest that he has the ability to use it in this circumstance. Other options would be taking money from funds for disaster relief or counter-drug operations.

As an example, the aides said there is funding for a medical facility at a USA base in Germany that has been partially built.

Senate Majority Leader Mitch McConnell, speaking on the Senate floor, called the legislation "a compromise that no side will view as a flawless deal", but he called it "a success for our bipartisan process" and reiterated his call for Trump to sign it. That does not mean Trump is happy with the deal, which provides him with even less border funding than was offered in December.

It would reduce US Immigration and Customs Enforcement detention beds from about 50,000 to 40,000. To the dismay of Democrats, however, it would still leave an agency many of them consider abusive holding thousands more immigrants than past year.

However, New York representative Alexandria Ocasio-Cortez and three other newly elected progressive Democrats who've been bucking party leadership said they'd vote against the compromise.

The aide said it would be impossible for leaders to decide a path forward until they see what Trump does.

The bipartisan legislation would provide more than $300 billion to fund the Department of Homeland Security and eight other federal agencies.

Trump sparked the last shutdown before Christmas after Democrats snubbed his $5.7 billion demand for the wall. The closure denied paychecks to 800,000 federal workers, hurt contractors and people reliant on government services and was loathed by the public. That will cover about 55 miles of new barriers, which can't be used for solid concrete walls.
