Huawei is suing the U.S. government

Huawei on Thursday opened a legal front in its counter-offensive against US warnings that it could aid Chinese intelligence services, filing suit to overturn a USA law that bars federal agencies from buying its products.

Huawei said it had filed a complaint at a federal court in Texas challenging Section 889 of the National Defence Authorisation Act (NDAA) - signed into law by US President Donald Trump in August - which bars federal agencies and their contractors from procuring its equipment and services. Prosecutors allege that Skycom is a hidden subsidiary of Huawei, while Huawei maintains they are two independent companies.

Huawei is also embroiled in a legal tussle over the December 1 arrest of Chief Financial Officer Meng Wanzhou by Canadian authorities after an extradition request from the United States over allegations of bank and wire fraud related to breaches of US-imposed sanctions on Iran.

The U.S. and China have tried to keep Meng's case separate from the trade dispute.

Some legal experts, however, said Huawei's lawsuit was likely to be dismissed because USA courts were reluctant to second-guess national security determinations by other branches of government.

"[The US government] has hacked our servers and stolen our emails and source code", rotating chairman Guo Ping said at a media conference.

Huawei Technologies Ltd.'s announcement comes as the biggest global maker of network equipment for phone and internet companies fights US efforts to persuade allies to exclude the company from next-generation telecom systems.

Last week, Meng's lawyers also said they were suing the Canadian government, its border agency and federal police, with allegations she was detained, searched and interrogated for three hours in violation of her constitutional rights.

Huawei accuses the USA government of hacking its servers and stealing its emails and Huawei source code, as well as attempting to influence United States allies and other governments worldwide to enact similar bans against the Chinese company.

Ms Meng - Mr Ren's daughter - is accused by the United States of bank and wire fraud related to breaches of trade sanctions against Iran.

The Chinese embassy statement has said that due to "obvious political interference", Canada should refuse the USA extradition request and release Meng.

Chief legal officer Song Liuping acknowledged, however, that Chinese laws may require Huawei to respond to government requests for assistance but said it would only do so in matters such as terrorism or criminal activity.

On March 1, Beijing revoked the license of Canada's largest agricultural handler, Winnipeg-based Richardson International, to ship canola to China, which puts Canadian farmers at risk of a glut.

Associate Chief Justice Heather Holmes set the next hearing for May 8, which is when the court will hear an outline of how the extradition proceedings will move forward. "Huawei has an excellent security record and program. No contrary evidence has been offered".

Canadian citizens Michael Kovrig, a former diplomat and now an analyst with Brussels-based global conflict monitoring think-tank Crisis Group, and Michael Spavor, a businessman and consultant, were detained after Meng's arrest.

Two affiliates also have been charged with stealing trade secrets from telecommunications group T-Mobile.
