Judge blocks Trump’s asylum policy

TIJUANA MEXICO- NOVEMBER 24 Members of the 'migrant caravan' wait in line to receive breakfast outside a temporary shelter set up for members of the caravan

"We support our federal partners", Pentagon spokesman Army Lieutenant Colonel Jamie Davis said when asked about Trump's comments.

The president's statements to reporters in the Oval Office came after Trump forced out top officials at the Homeland Security Department, including Secretary Kirstjen Nielsen, out of frustration that more wasn't being done to curb record-setting migration of families from Central America.

"They don't want to act", Trump said. The 20-day limit is the cause of the so-called catch-and-release loophole, which forces immigration authorities to release illegal aliens claiming asylum into the interior before their claims are adjudicated.

He's threatened to close the border down if Mexico doesn't act to prevent undocumented immigrants from seeking asylum in the U.S., which they are entitled to do by law.

The Republican is pushing hard for construction of hundreds of miles of new border wall and layers of razor wire.

Number of immigrants apprehended at the U.S. -Mexico border each month. But last summer, HHS started receiving babies and toddlers, and there was not enough space to house them, said Jonathan White, the career civil servant tasked by Health and Human Services with helping to reunify children. About 2,400 children were taken from parents at the height of the separations. Instead he blamed this on his Democratic predecessor Barack Obama.

TRUMP: "Just so you understand, President Obama separated the children".

"Those cages that were shown, I think they were very inappropriate", Trump said.

Democrats, aided by media outlets explicitly opposed to Trump, used the family separations as political ammunition to hammer the president.

"Indeed, in essence, plaintiffs are arguing that because they are subject to expedited removal, they should at a minimum have the protections they would enjoy under that regime, either by being exempt from contiguous territorial return, and/or by having additional procedural and substantive protections against being sent to places in which they would not be safe from persectuion", the judge wrote. "I was the one that changed it". Dianne Feinstein, D-Calif., a senior member of the Judiciary committee, said she plans to introduce a bill that would beef up immigration courts to reduce a huge backlog of cases and prohibit separations of migrant families.

However, Trump hugely accelerated the tough measures with a so-called zero-tolerance policy. They had child separation.

Before, families with children were largely allowed to stay together, whether on bail, in custody or being deported. After a federal judge ruled against the policy, it became clear to the public that there was little the administration could do to detain anyone traveling with a child for a long period of time.

About 1,000 migrants have been returned to Mexico since the policy went into effect and was later expanded across the California border and to West Texas.

The White House said Tuesday that it will appeal his ruling.

Even some of Trump's critics admit that the president has a point about USA asylum laws not being up to the current task: US immigration courts and the asylum system are overwhelmed, with 850,000 cases and 424 judges, making them inefficient and unwieldy.
